Terms of Service

1. Who we are

MyPresence provides a hosted service for individuals to build and publish a personal profile page. Throughout these terms, “we,” “us,” and “MyPresence” refer to the operator of the service, and “you” refers to the person using it.

2. Eligibility

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use MyPresence. By using the service you represent that you meet this requirement and that you have the right to enter into these terms.

3. Your account

You sign in with a supported identity provider (Google). You are responsible for keeping your sign-in credentials secure and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Subscriptions and payments

• Access to publishing features requires a paid subscription at the prices shown on our pricing page.
• Payments are processed by our payment provider. By subscribing you authorize us (and our payment provider) to charge the amount displayed at checkout.
• Subscriptions renew automatically at the end of each billing period unless you cancel before renewal. You can cancel any time from your dashboard; cancellation stops future charges but does not refund the current period.
• Prices and plans may change. We will give you reasonable advance notice before any price change takes effect for your subscription.
• Except where required by law, payments are non-refundable.

5. Your content

You retain ownership of the content you add to your MyPresence page. By submitting content you grant MyPresence a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit that content solely for the purpose of operating the service and publishing your page.

You are solely responsible for your content and represent that you have all rights necessary to publish it, and that it does not infringe anyone else’s rights or violate any law.

6. Acceptable use

You agree not to use MyPresence to:

• Impersonate another person or misrepresent your identity.
• Publish content that is unlawful, infringing, defamatory, obscene, hateful, harassing, or that incites violence.
• Distribute malware, run phishing or fraud schemes, or interfere with the integrity or performance of the service.
• Attempt to access accounts, data, or systems you are not authorized to access, or to probe, scan, or test the vulnerability of our systems.
• Scrape, mirror, or republish the service in ways that strain our infrastructure or violate these terms.
• Use the service in violation of any applicable law.

7. Our intellectual property

MyPresence, including the software, design, logos, and content we provide (other than your content), is owned by us or our licensors and is protected by intellectual-property laws. These terms do not grant you any rights in our brand except as expressly set out here.

8. Suspension and termination

We may suspend or terminate your account, remove content, or restrict access to the service if you violate these terms, if we are required to do so by law, or if we reasonably believe your actions pose a risk to MyPresence or its users. You may stop using the service and delete your account at any time from your dashboard.

9. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, MyPresence will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the service. Our aggregate liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold MyPresence harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the service, or your violation of these terms.

12. Changes to the service and terms

We may change the service or these terms from time to time. If we make material changes to these terms we will give reasonable notice by email or by posting a notice on the site. Continued use of the service after the changes take effect means you accept the updated terms.

13. Governing law

These terms are governed by the laws of India, without regard to its conflict-of-laws principles. The courts located in India will have exclusive jurisdiction over any dispute arising from these terms or the service, unless mandatory local law provides otherwise.
